Buhari Lacks Power To Approve State, LGA Police – Falana

A senior advocate of Nigeria and rights activist, Femi Falana, has said that President Muhammadu Buhari cannot single-handedly approve establishment of State and Local Government Areas police. In a brief statement in reaction to the recommendation of the Presidential panel on election reforms, Falana declared that the issue of establishing state police is a constitutional matter. He said President Buhari cannot decide on it. The senior lawyer said without going through the National Assembly for amendment of the Constitution, whatever decision unilaterally made by Buhari would not work. “Issue of state police is a constitutional one; there must be an amendment of the constitution in order for the president to approve the recommendation of the National Human Rights Commission. ...

The Controller-General of Prisons, Ja’afaru Ahmed, has approved the recommendation of Zone ‘C’ Disciplinary Committee for the dismissal of Prison Assistant 1, Umar Adamu, from the Nigerian Prisons Service for smuggling illicit drugs into the prison for prisoners. Ahmed further warned that any officer caught in such an ignoble act would be shown the way out of the service “as they have no business being in a character reformation agency.” A statement by the Prisons Service Public Relations Officer, DCP Francis Enobore, said Adamu’s dismissal was part of a concerted effort to maintain discipline and ensure that mal-adjusted inmates in prison custody were only handled by those with the required rectitude to do so. Why Buhari Is Yet To Act On NJC’s Recommendation

INDICATIONS emerged yesterday on why President Muhammadu Buhari is yet to act on the recommendation of the National Judicial Council (NJC) that the suspended Chief Justice of Nigeria (CJN), Justice Walter Onnoghen, be retired. The President, it was learnt, considered NJC’s letter ambiguous, as it did not clearly state why the suspended CJN should be retired. The President was also said to have received some legal advice to ignore NJC’s recommendations on Onnoghen because the council’s letter did not follow constitutional process. The ambiguity in NJC’s letter was said to have accounted for the current situation in which the nation is having a CJN and an Acting CJN. Findings made by our correspondent revealed that NJC’s recommendation to the President only advised him to ret...

CCT Dismisses Onnoghen’s Motions for Jurisdiction and Impartiality

The Code of Conduct Tribunal, CCT, Thursday dismissed the two motions of jurisdiction and impartiality pending determination for lack of merit. The motions are challenging the jurisdiction of the tribunal to handle the case of non-asset declaration and for the chairman of the tribunal, Danladi Umar to recuse himself from continuing to hear and preside over the case for purposes of bias. Danladi in his ruling said the grounds of the motion was essential because he was appointed by the Presidency and moreso, that the tribunal is directly under the presidency. It was argued that on this premise, he (Danladi) would not maintain impartiality, particularly as the Federal Republic of Nigeria stands as complainant against Justice Onnoghen. But Danladi, while dismissing ...
